Terms and Conditions of Service
Please ensure that you have read and understood the terms and conditions below. This document forms part of the agreement for makeup services between you and Rochelle O’Brien (“The Artist”). You are required to sign and date the booking form confirming your agreement to these terms and conditions.
The Trial
A mutually convenient time for the trial will be arranged to take place at The Artist’s studio. Trials are carried out on weekdays during school hours or at weekends by prior arrangement and to fit around current wedding bookings. It may occasionally be necessary to change the date of a trial that has already been agreed and every attempt will be made to accommodate another date that is convenient.
Once you are happy with the make-up design, The Artist will ensure that a detailed record of all cosmetic products used in the trial are recorded for her own personal use. Before and after photographs will be taken for record. On the wedding day it may be occasionally necessary for The Artist to deviate from the precise design as was agreed at the trial. This could be as a result of a change in your skin tone (due to the addition of a tan, for example), skin type (from oily to dry, for example) or simply as a result of the creative nature of the task.
It is your responsibility to notify The Artist of any health complaint, skin complaint, allergies or sensitivity to any part of your face or body that you are aware of at any time that the application of cosmetic products is due to commence. It is also your responsibility to ensure that any member of your party requiring make-up services supplies The Artist with the same information. If you (or any of your wedding party requiring make-up services) are suffering from any complaints or sensitivities, The Artist may be unable to apply cosmetic products including (but not exclusive of) make-up to the eyes, face, lips or body or skincare products such as moisturisers, cleansers or toners unless you produce a letter from your doctor expressly authorising the application of these products. The Artist’s decision in these circumstances is final.
At the trial, The Artist will agree with you a time to arrive and a time to leave on the wedding day. It is your responsibility to arrange other services (such as hairstyling etc) around these timings. Hair can be done before or after makeup.
Mileage
Twenty miles of travel each way is included in the prices. After this allowance, mileage is charged at 50p per mile each way.
The Wedding Day
The Artist will arrive at the location for bridal preparation at the agreed time. For the makeup area, The Artist requires a room with good natural lighting (failing that, space near a window) to set up her workstation. Sufficient space to set out the makeup kit will be required. The Artist will aim to have the bridal party’s makeup finished one hour before the ceremony time and will leave once the makeup is finished UNLESS you have agreed for The Artist to stay later to help with dressing etc.
PAYMENT
At the time of making a booking, a deposit of £100 will be taken by bank transfer or cheque. This covers the cost of your trial and is non-refundable in all circumstances.
Following the trial, you have 7 days to confirm your booking for the wedding day. If no confirmation is received within those 7 days, it will be assumed that you no longer wish to book for the wedding day and the date will be released.
Following your confirmation that you wish to book for your wedding day an invoice will be issued by email for the whole wedding day balance including the bridal party and is due within 7 days of the date of the invoice. Payment can be made by cheque or bank transfer.
Minimum booking policy
Whilst there is no specific minimum booking for wedding makeup and bookings are accepted at the discretion of The Artist, if the number of people requiring makeup reduces by three or more than was specified at the time of booking (for example you make a booking for a bride plus four adults which then reduces to bride only), The Artist reserves the right to cancel your booking and your deposit will not be refundable.
Once the balance has been settled in full, there are no refunds given. The only exception is if the wedding is cancelled (in which case a letter from the wedding venue confirming the same will be required) AND The Artist manages to fill the wedding date with another booking.
Bridal preparation at multiple locations
If it is necessary for The Artist to travel to two locations to carry out makeup services (for instance if you start getting ready at home and then move to the venue), a setting up fee of fifty pounds will apply. This is to cover the time spent travelling between the two locations, kit packing and setting up at the second location.
Cancellations by The Artist
In the unlikely event that The Artist is unable to attend your booking due to sickness, injury, personal emergency, inclement weather or any other circumstance beyond her control, she will endeavour to find a replacement make-up artist of a similar standard. This cannot, however, be guaranteed. If The Artist is unable to find a replacement makeup artist, you will receive a full refund of monies paid, less the trial cost.
Photography
The Artist will take pictures on the wedding day of the finished makeup. These pictures may or may not be used on Rochelle’s website www.rochelleobrien.co.uk, FaceBook or any other advertising which Rochelle undertakes. By signing these terms and conditions you are confirming that you have no objection to your photos being used in this way. If you object to your pictures being used, please say so here by signing your name:……………………………………………………………….
General
Rochelle O’Brien is not an insurer or a guarantor and disclaims all liability in such capacity. If you are seeking a guarantee against cancellation, loss or damage you should obtain appropriate insurance.
All services are conducted on the basis of the information, documents and/or photographs provided by you. Services are for the benefit of you and anyone who you choose to provide services for under this contract. Rochelle is not liable to you or any third party for any actions or omissions outside the remit of the service supplied. Nor is she liable for any problems arising as a result of unclear, erroneous, incomplete, misleading or false information supplied. Rochelle is not liable for any delayed, partial or total non-performance of the services arising directly or indirectly from any event outside her control including your failure to comply with any of your obligations.
Rochelle’s liability in respect of any claim for loss, damage or expense of any nature, shall in no circumstances exceed the costs of services she has been contracted to provide.
If any one or more provisions of these Terms and Conditions of Service are found to be illegal or unenforceable in any respect, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired by this.
I have read, understood and am in full agreement with the terms and conditions set out by Rochelle O’Brien. It is my full responsibility to make sure that all members of my bridal party abide by the terms and conditions contained in this document.
